Where does Right to Rent apply?
Right to Rent checks only apply in England. Scotland, Wales, and Northern Ireland do not currently require these checks.
When must I do the check?
You must check all adult occupiers before they move in. This includes anyone over 18 who will live in the property, not just the tenant named on the agreement.
What is a "statutory excuse"?
If you conduct proper checks, you get a "statutory excuse" which protects you from civil penalties if the tenant turns out to be illegal. Without proper checks, you have no protection.
Can I refuse based on nationality?
No. You must check everyone equally. Refusing to rent based on nationality is illegal discrimination. Only refuse if they cannot provide valid documents.
