Understanding Rent Repayment Orders

Rent Repayment Orders (RROs) allow tenants to reclaim rent paid during periods when a landlord was committing certain housing offences. With enhanced enforcement, these claims are increasing rapidly.

Offences That Trigger RROs

  1. Failure to licence an HMO - Most common cause
  2. Using violence to enter property
  3. Illegal eviction or harassment
  4. Failure to comply with improvement notice
  5. Failure to comply with prohibition order
  6. Breach of banning order

How Much Can Be Claimed?

  • Up to 24 months' rent (previously 12 months)
  • Tribunal considers landlord's conduct and financial circumstances
  • Awards typically range from 50-100% of rent paid during offence period

Case 1: Unlicensed HMO in Manchester Landlord failed to apply for mandatory HMO licence. Three tenants each awarded 12 months' rent. Total: £21,600.
