When to Use Section 13
Use Section 13 when:
- The fixed-term has ended and you're on a periodic tenancy
- There's no rent review clause in the tenancy agreement
- The tenant doesn't agree to a voluntary rent increase
The Section 13 Process
Step 1: Check Eligibility
- At least 12 months since tenancy started or last increase
- Property must be on a periodic tenancy
- Notice must be served correctly
Step 2: Determine the New Rent
Consider:
- Local market rates
- Property condition and improvements
- Tenant's circumstances
- Avoiding excessive increases that trigger tribunal challenges
Step 3: Serve the Correct Notice
- Use Form 4 for assured periodic tenancies
- Give minimum 1 month notice (monthly tenancy)

Step 4: Wait for Response
Tenant can:
